Terms Of Service

This agreement documents the terms of service for internet accounts provided by Elemint LLC to the account holder.  Elemint LLC is sometimes referred to as “we,” “us,” “our,” or “Elemint” and the account holder is sometimes referred to as “you,” or “your,”.

1. We will send invoices around the middle of each month for the next month of service.  Invoices are sent to the email address on file with us.  You can update this information anytime.  Regardless of whether an emailed invoice is received by you, the payment is due on the 1st of the month.  There will be a $30 charge for all bounced checks or cancelled payments.  If payment for an account becomes 10 days overdue, the account will be suspended until payment is received.  An account suspended for nonpayment will be unable to retrieve any emails or files from our servers.  If payment for an account becomes 30 days overdue, the account will be terminated and we may permanently erase all files, emails and other data associated with the account, without providing to you or preserving for you, copies of any files, emails or other data.  In the case of termination for the reason of nonpayment, you are still responsible for payment of all charges incurred up to the date the account was terminated.

2. You may cancel your account at any time.  You will be responsible for payment of all charges incurred up to the effective date of cancellation.

3. You agree to not hold Elemint responsible for any problems that may arise from any technical difficulties with the site or service (such as, but not limited to, server downtime).

4. Elemint's services may only be used for lawful purposes.  Transmission of any material in violation of International, Federal or State regulation is prohibited.  If you are found in violation of this agreement, your account will be terminated without notice and you will forfeit all of the moneys that have been paid to us.  You specifically agree to indemnify and hold Elemint harmless from any claims resulting from a breach of these terms, and/or use of the service, which damages another.

5. SPAM is NOT permitted and is grounds for immediate account termination.  Mailing lists via a mailing list manager are acceptable as long as lists are OPT-IN lists that people have signed up for.

6. You agree to keep all passwords and account information confidential and are solely responsible for any liability or damages resulting from your failure to maintain that confidentiality, and for all activities that occur under your password. You must immediately notify us if you suspect any breach of security such as loss, or unauthorized disclosure or use of your password and account.

7. While we will use every reasonable endeavor to ensure the integrity and security of the server, we do not guarantee that the server will be free from unauthorized users or hackers and we shall be under no liability for non-receipt or misrouting of email or for any other failure of email.

8. We will make reasonable efforts to ensure the server and services are available at all times but we shall not, in any event, be liable for interruptions of service or down-time of the server.

9. We shall have the right to suspend the services at any time and for any reason without notice.

10. In no event shall we ever be liable to the account holder for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.

11. This agreement contains the entire agreement of the parties with respect to the subject matter covered and supersedes any previous agreements, arrangements, undertakings or proposals, written or oral between the account holder and Elemint in relation to such matters.  No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions.

12. We reserve the right to modify this agreement at any time.  Any changes to these Terms Of Service are effective immediately upon publishing on http://admint.us/terms.  Continued usage of the account by you after such a change constitutes your acceptance of the revised terms.
